WAIVER AND RELEASE OF LIABILITY 1, the undersigned, individually as the Participant or individually and on behalf of my minor child or children (each a "Participant"), in consideration of being allowed to enter and use the Premises (as hereafter defined) HEREBY WAIVE AND RELEASE, indemnity and withhold harmless, and forever discharge, Nancy's Yoga Home, LLC, a Texas limited liability company, Nancy Kraut and her agents, employees, officers, directors, managers, affiliates, heirs, successors, and assigns (all jointly and severally the "Releasees") of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities of every kind and nature, whether known or unknown, in law or equity, that I or the Participant ever had, has or may have, arising from or in any way related to my and the Participant's participation in any events or activities conducted on the Premises. The Premises is that real property, together with any improvements, located at 4004 Morning Glory Lane, Plano, Texas 75093, owned by Nancy Kraut, operated by Nancy's Yoga Home, LLC. I acknowledge and fully understand that each Participant will, or may, be engaging in activities that involve risk of serious injury, including permanent disability and death, and severe social and economic losses which may result not only from their own actions, inactions or negligence but the action, inaction or negligence of others, or the condition of the Premises or of any equipment used. Further, I accept personal responsibility for any and all damages following such injury, permanent disability or death. I am aware of the physical risks involved with strenuous exercise and understand it is my personal responsibility to consult with my doctor regarding my participation. I affirm that I alone am responsible to decide whether to practice yoga. I have no medical condition that would prevent me from taking part in yoga classes or workshops, and I assume responsibility for any risk or injury I may sustain as a result of my participation. 1 HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT 1 HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child's involvement or participation in the activities on the Premises, even if arising from Releasees' negligence, to the fullest extent permitted by law.
